1. Platform Overview

chubbycheeks ("we", "us", "our") operates https://chubbycheeks.co, a peer-to-peer marketplace that connects parents and caregivers to list, rent, and hire baby and children's equipment.

By accessing or using our platform, you agree to be bound by these Terms and Conditions.

If you do not agree to these terms, you must not use the platform.

2. Eligibility

To use chubbycheeks, you must:

• Be at least 18 years old
• Have the legal capacity to enter into binding agreements
• Provide accurate and truthful information during registration
• Comply with all applicable laws and regulations

3. Account Registration

You are responsible for maintaining the confidentiality of your account credentials.

You must notify us immediately of any unauthorised use of your account.

We reserve the right to suspend or terminate accounts that violate these terms.

4. Listings

If you list items on chubbycheeks, you agree to:

• Provide accurate descriptions, photos, and pricing
• Provide a reasonably accurate estimated value for the item (within 10% of actual value)
• Include serial numbers or identifying information where applicable
• Upload clear photos showing the item's current condition
• Ensure all items are safe, clean, and in good working condition
• Comply with all relevant safety standards and regulations
• Not list recalled, counterfeit, or prohibited items
• Honour confirmed bookings unless cancellation is unavoidable

We reserve the right to remove listings that do not meet our quality or safety standards.

5. Prohibited Items

The following items may not be listed on chubbycheeks:

• Car seats and infant carriers (due to unknown crash history and safety concerns)
• Items subject to active safety recalls
• Items past the manufacturer's recommended lifespan
• Items that are damaged, broken, or not in safe working condition
• Counterfeit or non-certified products
• Any items that would be illegal to hire in the UK

We reserve the right to remove any listing that we deem unsafe or inappropriate for our platform.

6. Bookings

When renting items through chubbycheeks, you agree to:

• Use items only for their intended purpose
• Return items on time and in the same condition as received
• Report any damage or issues immediately
• Not sub-rent or transfer items to third parties
• Follow all safety instructions provided by the owner

Bookings are subject to availability and owner approval. Items must only be collected by and handed over to the verified renter who made the booking.

7. Payments

All payments are processed securely through our third-party payment provider.

chubbycheeks charges a service fee on each transaction, which is displayed before booking confirmation.

Owners receive payouts after the rental period begins, subject to our payment terms.

8. Deposits and Damage

A refundable security deposit may be required for certain bookings. Deposits are held in escrow and released after successful completion of the rental.

Normal Wear and Tear

Normal wear and tear refers to minor marks, scratches, or cosmetic imperfections that do not affect the functionality or safety of the item. Claims for normal wear and tear will not be accepted.

Damage Claims

In case of damage beyond normal wear and tear, the owner may submit a claim against the deposit. To submit a valid claim, owners must provide:

• Photographs showing the item's condition before and after the rental
• Proof of item value (receipts, market valuations, or listing value)
• A police report (in cases of theft or criminal damage)
• A clear description of the damage and estimated repair or replacement cost

Claims must be submitted within 72 hours of the rental end date. Failure to provide adequate documentation may result in the claim being reduced or denied.

Claim Valuation

Compensation for damage claims is based on the fair market value of the item at the time of the incident, taking into account its age, wear, and overall condition. We may apply depreciation based on the item's age and type.

Disputes are resolved through our claims process, with evidence from both parties considered.

9. Exclusions

The following are not covered by our deposit protection and claims process:

• Normal wear and tear (minor marks, scratches, or cosmetic imperfections that do not affect functionality)
• Mechanical or electrical faults caused by inherent defects, poor maintenance, or pre-existing damage
• Damage caused by corrosion, humidity, extreme temperatures, or environmental factors
• Events beyond normal rental risks, such as natural disasters, war, terrorism, or riots
• Items in transit through third-party courier services (the platform is not responsible for damage or loss during shipping)
• Lost income or consequential losses due to late returns or unavailability of items
• Damage caused by previous incidents or underlying structural weakness from prior impact
• Public or product liability (injury to persons or damage to third-party property)

Rentals arranged outside the chubbycheeks platform are not covered by our deposit protection or claims process.

10. Cancellations

Cancellation policies are set by individual owners and displayed on each listing.

Refunds are processed according to the applicable cancellation policy.

chubbycheeks may retain service fees in certain cancellation scenarios.

11. User Responsibilities

All Users

• Communicate respectfully with other users
• Honour commitments made through the platform
• Not engage in fraudulent or deceptive behaviour
• Not circumvent the platform to avoid fees
• Report any safety concerns or suspicious activity

Lenders

Lenders must take reasonable precautions to prevent damage, loss, or theft. This includes ensuring items are properly packaged and protected during handover, providing clear usage and safety instructions, and ensuring that sensitive or fragile items are adequately safeguarded.

Lenders are expected to fully cooperate with chubbycheeks throughout any claims process, including providing requested documentation in a timely manner.

Renters

Renters must collect items in person or through an agreed method, and must not transfer items to unverified third parties. Renters are responsible for the safe use and return of items, and must report any incidents as soon as possible after they occur.

12. Fraud and Misrepresentation

chubbycheeks takes fraud seriously to protect the integrity of the platform and ensure fair outcomes for all users. Any attempt to provide false information, inflate damage claims, conceal relevant facts, or commit fraud may result in:

• Denial of claims
• Recovery of previously paid claims or funds
• Immediate account suspension or termination
• Legal action

13. Liability

chubbycheeks acts as a platform connecting users and is not party to rental agreements between owners and renters.

We do not inspect items and make no guarantees regarding their safety, quality, or suitability.

Users are responsible for verifying item condition and safety before use.

To the fullest extent permitted by law, chubbycheeks is not liable for any loss, damage, or injury arising from the use of items rented through the platform.

14. Termination

We may suspend or terminate your access to chubbycheeks at any time for violation of these terms.

You may close your account at any time by contacting us.

Upon termination, any pending bookings may be cancelled and deposits handled according to our policies.

15. Governing Law

These terms are governed by the laws of England and Wales. Any disputes arising from these terms or your use of the platform shall be subject to the exclusive jurisdiction of the courts of England and Wales.
